Our service terms and your rights as a customer

1. About These Terms

These Terms and Conditions ("Terms") govern your use of AlgoMath Club's educational services and website. By enrolling in our courses or using our services, you agree to these terms. These terms comply with Dutch consumer protection law and educational service regulations.

2. Our Services

2.1 Educational Services

AlgoMath Club provides mathematics and programming education services including:

  • Individual and group mathematics courses (Explorers, Challengers, Masters tracks)
  • Programming courses (Python, coding fundamentals)
  • School enrichment programs (CCAs)
  • 1:1 tutoring sessions
  • Contest preparation and advanced mathematics training

2.2 Service Delivery

Services are delivered at our current location in the Amstelveen/Amsterdam area, online, or at school premises (for CCA programs). Our physical location may change due to rental arrangements or operational needs. We will provide at least 14 days advance notice of any location changes to enrolled students. We reserve the right to modify delivery methods or locations based on circumstances, with advance notice to enrolled students.

3. Enrollment and Registration

3.1 Age Requirements

Our services are designed for students aged 11-18. For students under 16, parental consent is required under Dutch law. Parents/guardians are responsible for enrollment decisions and contract obligations.

3.2 Course Prerequisites

Some advanced courses (Masters Track) require assessment or diagnostic evaluation. We reserve the right to recommend alternative courses based on student readiness.

3.3 Enrollment Confirmation

Enrollment is confirmed upon:

  • Receipt of completed enrollment form
  • Payment of applicable fees
  • Written confirmation from AlgoMath Club

4. Payment Terms

4.1 Course Fees

Course fees are communicated during enrollment and must be paid according to agreed schedule. All prices include applicable Dutch VAT where required.

4.2 Payment Methods

We accept bank transfers, iDEAL, and other payment methods as communicated. Payment terms are typically 14 days from invoice date unless otherwise agreed.

4.3 Late Payment

Late payments may result in course suspension. We reserve the right to charge interest on overdue amounts according to Dutch commercial law.

5. Cancellation and Refund Policy

5.1 Consumer Rights (Dutch Law)

Under Dutch consumer protection law, you have the right to cancel within 14 days of enrollment without stating reasons, provided the course has not yet commenced.

5.2 Course Cancellation by Student

  • Before course starts: Full refund minus administrative fee (maximum €25)
  • Within first week: Pro-rated refund for remaining sessions
  • After first week: No refund, but transfer to future course may be possible

5.3 Course Cancellation by AlgoMath Club

If we cancel a course due to insufficient enrollment or other reasons, students receive full refund or transfer to alternative course at no additional cost.

6. Attendance and Behavior

6.1 Attendance Requirements

Regular attendance is expected. Missed sessions cannot be refunded, but makeup arrangements may be possible at our discretion.

6.2 Student Conduct

Students must maintain respectful behavior. We reserve the right to remove disruptive students without refund.

6.3 Health and Safety

Parents must inform us of relevant health conditions. Students experiencing illness symptoms (including fever, cough, or other contagious conditions) should not attend in-person sessions to protect the health of all participants. Online participation may be available as an alternative when possible.

7. Intellectual Property

7.1 Course Materials

All course materials, curricula, exercises, problems, and teaching content are proprietary to AlgoMath Club. Students may not reproduce, distribute, share, or commercially use our materials, including exercise problems, worksheets, or any course content.

7.2 Student Work

Students retain rights to their personal solutions and work completed during courses for their own reference and portfolio use. However, students may not distribute, share, or reproduce AlgoMath Club's exercise problems, course materials, or teaching content, even when combined with their solutions. AlgoMath Club retains all rights to teaching methods, problem sets, and instructional content.

8. Liability and Insurance

8.1 Limitation of Liability

AlgoMath Club's liability is limited to the fees paid for the specific course. We are not liable for:

  • Academic outcomes, exam results, competition rankings, university admissions, scholarship awards, or any specific educational achievements
  • Individual differences in learning pace, comprehension speed, or mathematical aptitude
  • Student placement in advanced programs, teams, or competitions based on skills developed in our courses
  • Indirect or consequential damages including but not limited to lost wages, travel costs, or related expenses
  • Loss of opportunity, future earnings, potential scholarships, or speculative benefits
  • Force majeure events including but not limited to pandemics, natural disasters, government restrictions, facility closures, technical failures, or any circumstances beyond our reasonable control

8.2 Insurance Coverage

We maintain appropriate professional liability insurance. Students should ensure they have adequate personal insurance coverage.

8.3 Property Damage

Students/parents are liable for any damage to AlgoMath Club property, equipment, or rental facility property (including furniture, equipment, and facilities at any venue where classes are conducted) caused during sessions. This includes damage to third-party property at locations where classes are held.

9. Data Protection and Privacy

Personal data processing is governed by our Privacy Policy, which complies with GDPR. By using our services, you consent to data processing as described in our Privacy Policy.

10. Communication and Complaints

10.1 Official Communications

Official communications will be sent to the email address provided during enrollment. It is your responsibility to keep contact information current.

10.2 Complaint Procedure

Complaints should be submitted in writing to contact@algomathclub.com. We will acknowledge receipt within 3 business days and provide resolution within 14 days.

11. Force Majeure

AlgoMath Club is not liable for failure to perform due to circumstances beyond reasonable control, including but not limited to:

  • Natural disasters (floods, earthquakes, severe weather)
  • Government actions (lockdowns, health restrictions, policy changes)
  • Pandemics or public health emergencies
  • Technical failures (internet outages, platform disruptions)
  • Facility issues (rental space unavailability, building closures)
  • Transportation disruptions or infrastructure failures
  • Acts of terrorism, war, or civil unrest

In such cases, we will make reasonable efforts to reschedule sessions, provide alternative delivery methods, or offer appropriate remedies including course credits or refunds where applicable.

12. Modifications to Services and Terms

12.1 Service Changes

We may modify course content, schedules, delivery methods, or physical locations with reasonable notice. Location changes will be communicated at least 14 days in advance when possible. Significant changes affecting fees will require customer consent. If a location change significantly impacts accessibility for a student, we will work to find suitable alternatives or offer course transfers.

12.2 Terms Updates

These terms may be updated periodically. Significant changes will be communicated via email and posted on our website.

13. Dispute Resolution

13.1 Governing Law

These terms are governed by Dutch law. Any disputes will be subject to the jurisdiction of Dutch courts.

13.2 Alternative Dispute Resolution

Before proceeding to court, we encourage mediation through recognized Dutch mediation services for consumer disputes.

13.3 European ODR Platform

EU consumers may access the Online Dispute Resolution platform at: ec.europa.eu/consumers/odr

14. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
